1. Introduction

TrackGuard ("Company," "we," "our," or "us") operates an AI-powered security operations platform available at www.trackguard.co and through our mobile applications (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use our Service, including our web platform, mobile applications for security guards ("Guard App"), client-facing portals ("Client Portal"), and administrative dashboards ("Admin Dashboard").

By accessing or using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access the Service.

2. Information We Collect

2.1 Information You Provide Directly

We collect information you voluntarily provide when you:

  • Register for an account or request a demo (company name, contact name, business email address, phone number, number of security guards, state of operation)
  • Set up your organization's profile (company logo, brand colors, domain name for white-label configuration)
  • Create guard profiles (guard name, employee ID, assigned sites, shift schedules, contact information)
  • Create client accounts (client company name, contact information, site addresses, access permissions)
  • Submit incident reports, patrol logs, or activity notes through the platform
  • Communicate with our support team via email or in-app messaging

2.2 Location and GPS Data

Our Service collects precise geographic location data as a core function of the platform. Specifically:

  • Guard App (Mobile): When a security guard uses the Guard App, we collect real-time GPS coordinates to enable patrol tracking, geofence verification, checkpoint scanning, and site monitoring. Location data is collected continuously during active shifts and when the app is running in the foreground. With explicit permission, location may be collected in the background during active duty periods.
  • Geofence Data: We collect entry and exit timestamps when guards enter or leave designated site boundaries.
  • Checkpoint Data: We collect time-stamped location records when guards scan NFC tags or QR codes at designated patrol checkpoints.

Location data is linked to individual guard accounts and is visible to authorized administrators and clients through the platform dashboard.

2.3 Device and Usage Data

We automatically collect certain information when you access the Service:

  • Device identifiers (device type, operating system, unique device ID)
  • IP address and approximate geographic location derived from IP
  • Browser type and version
  • Pages visited, features used, time spent, and interaction patterns
  • App version and crash reports
  • Push notification tokens for alert delivery

2.4 AI-Generated Data

Our platform uses artificial intelligence and machine learning to:

  • Automatically generate incident reports and patrol summaries from guard activity data
  • Analyze patrol patterns to identify coverage gaps or anomalies
  • Generate scheduling recommendations based on historical data
  • Produce automated client reports summarizing security activity

AI-generated content is derived from the operational data described above and is stored as part of your account records.

2.5 Communications Data

We retain records of:

  • In-platform messages between guards, administrators, and clients
  • Automated alert notifications sent via push notification, SMS, or email
  • Support communications and help desk tickets
  • Email correspondence related to your account

3. How We Use Your Information

We do not sell your personal information to third parties. We do not use guard location data for any purpose other than providing the Service to the security company that employs them.

4. White-Label and Multi-Tenant Data Practices

TrackGuard operates as a white-label B2B platform. Security companies ("Operators") use TrackGuard to power their own branded platforms. In this context:

  • Operators are data controllers for the data of their guards and clients.
  • TrackGuard acts as a data processor on behalf of Operators.
  • Guard and client data collected through an Operator's white-label instance is owned by and attributable to that Operator.
  • Operators are responsible for obtaining appropriate consent from their guards and clients for data collection, including location tracking.
  • TrackGuard will process such data only in accordance with Operator instructions and this Privacy Policy.

If you are a guard or client of a security company using TrackGuard's white-label platform, please also review that company's privacy policy, as they are the primary data controller for your information.

5. Sharing and Disclosure of Information

We may share your information in the following circumstances:

5.1 Within Your Organization

Guard location data, patrol logs, incident reports, and activity summaries are shared with authorized administrators and clients within your organization's TrackGuard account, according to the permission levels you configure.

5.2 Service Providers

We share information with trusted third-party vendors who assist us in operating the Service, including cloud infrastructure providers, email delivery services, analytics providers, payment processors, and push notification services. All service providers are contractually obligated to protect your information and use it only for the purposes for which it was disclosed.

5.3 Legal Requirements

We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court order or government agency request), or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

5.4 Business Transfers

In the event of a merger, acquisition, reorganization, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email and/or prominent notice on our Service of any change in ownership or uses of your personal information.

5.5 Aggregated and Anonymized Data

We may share aggregated, anonymized data that cannot reasonably be used to identify you for industry research, benchmarking, or product improvement purposes.

6. Data Retention

We retain your information for as long as your account is active or as needed to provide the Service. Specifically:

  • Account data: Retained for the duration of your subscription plus 90 days after account closure, unless a longer retention period is required by law.
  • Guard location and patrol data: Retained for 12 months by default. Operators may configure longer retention periods for compliance purposes.
  • Incident reports and activity logs: Retained for 24 months by default.
  • AI-generated reports: Retained for the same period as the underlying activity data.
  • Billing records: Retained for 7 years in accordance with financial record-keeping requirements.

Upon account closure, we will delete or anonymize your data within 90 days, except where retention is required by applicable law.

7. Data Security

We implement industry-standard technical and organizational security measures to protect your information, including:

  • Encryption of data in transit using TLS 1.2 or higher
  • Encryption of sensitive data at rest using AES-256
  • Role-based access controls limiting data access to authorized personnel
  • Regular security audits and vulnerability assessments
  • Secure development practices and code review processes
  • Incident response procedures for data breach detection and notification

No method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee absolute security.

8. Your Rights and Choices

Depending on your location and applicable law, you may have the following rights regarding your personal information:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Request correction of inaccurate or incomplete information.
  • Deletion: Request deletion of your personal information, subject to legal retention requirements.
  • Portability: Request a machine-readable export of your data.
  • Objection: Object to certain processing activities, including direct marketing.
  • Restriction: Request that we restrict processing of your information in certain circumstances.
  • Withdrawal of Consent: Where processing is based on consent, withdraw consent at any time without affecting the lawfulness of prior processing.

8.1 Location Data Controls

Guards may disable location sharing through their device settings; however, doing so may prevent the Guard App from functioning as required by their employer. Guards should contact their employer (the Operator) regarding location data practices during employment.

8.2 Marketing Communications

You may opt out of marketing emails at any time by clicking the "unsubscribe" link in any marketing email or by contacting us at [email protected]. Transactional and operational emails related to your account cannot be opted out of while your account is active.

9. Children's Privacy

The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that a child under 18 has provided us with personal information, we will take steps to delete such information. 10. International Data Transfers

TrackGuard is operated in the United States. If you are accessing the Service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States or other countries where our service providers operate. By using the Service, you consent to such transfers. We take appropriate safeguards to ensure that your personal information remains protected in accordance with this Privacy Policy.

11. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):
